Five European cannabis models, no two alike

Home grow, clubs, trials, medical-only and a crackdown: what each European model allows as of 13 October 2026, and what the evidence can and cannot yet say.

Within a few hours' drive in Europe, the law on cannabis changes completely. In one country, adults may grow a few plants at home. In another, a licensed grower supplies coffeeshops under a government experiment. In a third, selling low-THC hemp flower can bring drug-law penalties.

There is no European legalisation and no single European model. As of 13 October 2026 there are at least five approaches running side by side, and most are young enough that the evidence is still arriving. We checked the limits against statutes and regulator pages where we could reach them, and we say where we could not.

Why now: the EU drugs agency published its 2026 report in June, Czechia's reform took effect on 1 January, a Swiss parliamentary committee sent its draft law back for revision in May, and Italy's hemp ban is heading to the Constitutional Court. Here is the map.

Table of five European cannabis models across nine countries, with each country's key limit and start date
Selected countries, not exhaustive. Chart: CannaLib. Data: statutes and regulator pages listed in our sources, checked 13 October 2026.

The baseline: plenty of Europeans use it anyway#

The European Union Drugs Agency (EUDA) published its 2026 European Drug Report in June. It estimates that 8.7% of European adults aged 15 to 64, about 25 million people, used cannabis in the past year. For 15 to 34-year-olds in the EU the estimate is 15.3%. About 1.6% of adults use daily or almost daily. The figures come from population surveys, mostly run between 2015 and 2024.

The agency also tracks potency in seized material. In 2024 the average THC content of cannabis resin seized in the EU was 24.6%, about twice the 12% for herbal cannabis. Between 2014 and 2024 average resin potency rose by 66% and herbal potency by 19%. Seizures are not the same as what is sold, so read these as indicators, not a market average.

That is the reality every policy below is trying to manage.

Model 1: grow your own#

Luxembourg passed its home-grow law on 10 July 2023, published in the Mémorial on 17 July. Adults may grow up to four plants "per domestic community", the statute's term, and use cannabis at home. Public use stays banned. The limit is per household, so four plants is four plants whether one adult lives there or three. There are no clubs and no legal shops.

Czechia followed on 1 January 2026. Czech and international media report that adults over 21 may grow up to three plants, keep up to 100 grams at home and carry up to 25 grams in public. The change came through Act 270/2025 Coll., which amends the Criminal Code and related laws. We could not open the full statute text. The legal publisher Sagit's annotation of the Act confirms the three-plant and 100-gram home limits and the 1 January 2026 start, a Czech legal explainer places the 25-gram public limit and the age rule in the Addictive Substances Act, and several press reports agree. Sales and larger quantities remain offences, though cases once treated as intent to sell are now handled as possession of a larger amount.

The trade-off is plain: personal use leaves the criminal system, but nobody gets a legal supply unless they grow. Jindřich Voboriř, the former national drug coordinator, called the Czech change "only a partial step" (our translation) and noted that people who cannot grow, such as a wheelchair user or a pensioner in a small flat, still lack legal access.

Model 2: clubs#

Malta went first. Its Authority on the Responsible Use of Cannabis Act took effect on 18 December 2021, and Malta is widely described as the first EU country to legalise adult personal use. Under the consolidated Drug Dependence Act, possessing up to seven grams for personal use is not an offence for a person over 18. Up to four plants and 50 grams of dried cannabis are covered at a registered home address, regardless of how many people live there. Public consumption remains an offence, with a EUR 235 penalty under Article 4A(3).

The bigger idea is the non-profit cannabis association. The law caps each at 500 members, and no member may receive more than seven grams in a day or 50 grams in a calendar month. The Authority licenses them, and its own list of associations with an operating permit named 24 when we checked on 13 October 2026. The page is undated; trade press had counted 19 in 2025 and 22 by February 2026.

Germany combined home growing (three plants, from 1 April 2024) with cultivation associations, which the law allowed from 1 July 2024. We cover the evidence in Germany, two and a half years in. The short version: the official evaluation finds home growing has become a significant source, clubs could have supplied at most 3.5% of consumers in 2025, and no rise in consumption traceable to the reform is yet visible. It is an interim report, and doctors' societies say the data are too thin to call.

The club idea's appeal is legal supply without an industry that profits from selling more. Its weakness is scale: clubs are capped, fiddly to set up and slow to license.

Model 3: the controlled trial#

Two countries are testing before they commit.

The Netherlands long tolerated coffeeshops while keeping their supply illegal, the famous "back door problem". On 7 April 2025 the experimental phase of the Closed Coffeeshop Chain Experiment began. According to Associated Press reporting, 10 municipalities, among them Breda, Groningen, Maastricht and Tilburg, take part, with 10 licensed growers supplying about 80 coffeeshops. Regulated hash followed after a transition period.

One year on, Breda's mayor Paul Depla told the newspaper Trouw: "Customers haven't walked away. Sales in the shops haven't decreased." He said no street dealing was emerging. The Justice and Security Inspectorate made 46 inspections of growers in 2025, found 42 violations, mostly registration-system errors and security lapses, and demanded four fines of between EUR 1,000 and EUR 20,000. The government plans to decide whether to continue at the end of 2029. That is a mayor's view and an early inspection tally, not an evaluation.

The first official measurement arrived on 9 September 2026, when the justice and health ministers sent parliament the first follow-up report by Breuer&Intraval, RAND Europe and the Trimbos Institute. Covering 7 April 2025 to the first quarter of 2026, it found no change in coffeeshop visitor numbers or how often people use, a wider product range in the experiment towns, cheaper weed and dearer hash there, and an illegal market that persists mainly on price. The authors call the results exploratory after about three months of exposure, and the ministers say no conclusions can be drawn before the final evaluation.

Switzerland has allowed time-limited scientific pilot trials since 15 May 2021 under Article 8a of its Narcotics Act, capped at 5,000 participants each. The federal health office's second annual analysis, dated 17 November 2025, covered seven ongoing trials in Vernier, Lausanne, Bern, Biel, Lucerne, Zurich and Basel, with about 10,400 adult participants as of June 2025. The authors warn the sample is not representative: 78% are male, and younger adults and occasional users are underrepresented.

In parallel, the National Council's health committee has drafted a Cannabis Products Act for a regulated, non-commercial market. As drafted, cantons would license non-profit points of sale, with profits going to prevention and addiction services. The consultation drew 162 responses. Of the 26 cantons that replied, 10 supported the draft and 15 rejected or somewhat rejected it, with enforcement cost the commonest complaint. On 8 May 2026 the committee voted 16 to 8 to send the bill back to its subcommittee for revision, and rejected 17 to 8 a proposal to pause until the pilots are fully evaluated. It still has to pass both chambers and could face a referendum.

Model 4: medical only, and growing fast#

The United Kingdom changed the law on 1 November 2018 so that doctors on the General Medical Council's specialist register could prescribe unlicensed cannabis-based products without a Home Office licence. It was meant to be a narrow door.

It no longer looks narrow. The Independent, reporting NHS Business Services Authority figures on 6 October 2026, said 1,967,268 items of unlicensed cannabis medicine were prescribed privately in England in the 12 months to May 2026, with flower making up about three-quarters. The same report put 2024 at 659,293 items, up from 282,920 in the preceding 12-month period. The 2026 figure comes from a Press Association analysis of NHSBSA data, carried by The Independent and other outlets. We could not retrieve the dataset itself, so we treat it as reported rather than independently confirmed. England's Patient Safety Commissioner, Professor Henrietta Hughes, said: "The growth of medicinal cannabis prescribing has outpaced the systems needed to ensure patient safety."

Bar chart of items of unlicensed cannabis medicine prescribed privately in England: 282,920 in a prior 12 months, 659,293 in 2024, 1,967,268 from June 2025 to May 2026
Items, not patients, and the periods differ. Chart: CannaLib. Data: NHSBSA figures as reported by The Independent, 6 October 2026.

Spain took a stricter route. On 7 October 2025 its cabinet approved a royal decree (reported as Real Decreto 903/2025) on medicinal cannabis. The health ministry's release says the preparations may be prescribed only by hospital specialists, and must be made and dispensed in authorised hospital pharmacy services. That is a closed hospital channel, not a private market.

Model 5: the crackdown#

Italy is going the other way. Decree-law no. 48 of 11 April 2025, a security package, was converted into law by Law no. 80 of 9 June 2025, with Article 18 unchanged. It bans importing, selling, processing, distributing, transporting and consuming products made from hemp flowers, with an exception for seed production, and enforces the ban through the drug law's penalties. That swept up the "cannabis light" shops that had operated under a 2016 hemp law. Hemp trade groups said up to 30,000 jobs and more than 3,000 businesses were at risk in a sector they valued at nearly EUR 2 billion. Those are industry figures.

The law is in force, but contested. A criminal court in Trani referred Article 18 to the Constitutional Court on 28 April 2026, arguing the decree lacked the necessary urgency, that the ban offends the principle of offensiveness, and that it restricts the free movement of goods in the EU. A Brindisi judge had already referred the same article on 2 December 2025, and Italian media report a third referral from Brescia in July 2026. The Constitutional Court has joined the three and, after moving a hearing first listed for 21 October 2026, will hear them on 9 February 2027. Separately, the Council of State asked the EU Court of Justice on 11 November 2025 whether Italy's hemp restrictions square with the free movement of goods (Case C-716/25); that case is also pending.

What the patchwork tells us#

Each model answers a different question. Home growing asks whether we can stop criminalising users without building a market. Clubs ask whether legal supply can exist without an industry. The Dutch and Swiss trials ask whether we can prove it works first. Medical-only systems ask whether it can stay a medicine. Italy asks whether the hemp loophole can be shut.

None has a complete answer. The Dutch and Swiss data are early. Germany's evaluators see no traceable rise in use, and its doctors want more years of evidence. The UK shows how a narrow medical door can widen fast. Italy shows the direction of travel is not one-way.

The next real tests are on the calendar: the Italian Constitutional Court in February 2027, the Swiss subcommittee's revised bill, and the Dutch decision in 2029. Until then, Europe's best lesson is that "legal" is a postcode, not a status. What is lawful in one country is not lawful in the next one along, and nothing in this article is advice to test the difference.
